Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Oney Finansal Danışmanlık Turizm ve Dış Ticaret A.Ş. ("ELUMA," "Company," "we," "us"), governing your access to and use of the ELUMA mobile application and the eluma.me marketing website (collectively, the "Service"). ELUMA is a brand of Oney World.

By creating an account, downloading the application, or otherwise using the Service, you represent that you are at least 13 years of age and have the legal capacity to enter into this agreement. If you are between 13 and 16 and resident in the European Economic Area, your parent or legal guardian must consent on your behalf.

Account Responsibilities

One account per user. You may maintain only one ELUMA account. Creating duplicate accounts is prohibited.

Accurate information. You agree to provide accurate, current, and complete information at registration and to keep your account information updated.

Security of credentials. You are responsible for maintaining the confidentiality of your password and for all activity occurring under your account. Notify us immediately at info@oneyworld.com if you suspect unauthorised access.

No transfers. Your account is personal to you and may not be transferred or assigned to another person.

Use of Service

AI recognition accuracy. ELUMA's landmark recognition is powered by artificial intelligence and is provided on a best-effort basis. Recognition results may be inaccurate, incomplete, or unavailable for certain landmarks or in certain conditions. You should not rely solely on ELUMA's output for safety-critical or legal decisions. We make no warranty as to the accuracy, completeness, or fitness for any particular purpose of recognition results or associated historical narratives.

Permitted use. The Service is provided for personal, non-commercial use. You agree not to: (a) reverse-engineer, decompile, or disassemble any part of the Service; (b) scrape, crawl, or extract data in bulk; (c) use the Service to transmit harmful, defamatory, or unlawful content; (d) impersonate any person or entity; (e) circumvent any technical measures; or (f) use the Service in any manner that could damage, disable, or impair the Service or its infrastructure.

Ticket Purchases

Operator disclosure. Ticket sales on ELUMA are operated by Misyura Travel, holder of TURSAB License No. 17192, under applicable Turkish tourism law. By purchasing tickets through ELUMA, you accept Misyura Travel's terms and conditions in addition to these Terms.

Final sale. Ticket purchases are final sale subject to the refund and cancellation terms described in our Refund & Cancellation Policy, which is incorporated herein by reference.

Accuracy of booking information. You are responsible for ensuring the accuracy of all booking details (dates, number of visitors, visitor categories) before completing a purchase. ELUMA and Misyura Travel are not responsible for bookings made with incorrect information provided by the user.

Payment processing. Payments are processed by licensed payment service providers. Your card data is never transmitted to or stored by ELUMA.

Intellectual Property

ELUMA brand and content. All ELUMA trademarks, logos, application design, and AI-generated historical narratives are the property of Oney Finansal Danışmanlık Turizm ve Dış Ticaret A.Ş. or its licensors. Nothing in these Terms grants you a right to use our trademarks, trade dress, or other brand elements.

User-submitted content. You retain all rights you hold in images and content you submit through the Service. By submitting content, you grant ELUMA a limited, non-exclusive, royalty-free, worldwide licence to use that content solely to provide and improve the Service (e.g., to process your recognition request). This licence terminates when you delete your content or account.

No derivative works. You may not reproduce, distribute, modify, or create derivative works from ELUMA content without prior written authorisation.

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

Third-party content linked or referenced through the Service (including Headout, Wikipedia, or other heritage databases) is provided by those third parties and ELUMA assumes no responsibility for its accuracy or availability.

Limitation of Liability

To the maximum extent permitted by applicable law, ELUMA's total aggregate liability to you for any claim arising out of or relating to these Terms or the Service — whether in contract, tort, statute, or otherwise — is limited to the amount you paid to ELUMA in the twelve (12) months preceding the claim.

In no event shall ELUMA be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by applicable law.

Force Majeure

Neither party shall be in breach of these Terms nor liable for any delay in performing, or any failure to perform, any obligation if such delay or failure results from events, circumstances, or causes beyond their reasonable control, including acts of God, pandemic, governmental actions, telecommunication outages, or extreme weather events.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where required, by in-app notification or email. Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance. If you do not agree with the modified Terms, your sole remedy is to cease using the Service and close your account.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Istanbul (Çağlayan), Turkey.

Consumer dispute resolution. If you are a consumer located in Turkey, you may refer disputes within the statutory monetary thresholds to the competent Tüketici Hakem Heyeti (Consumer Arbitration Panel) in your district before resorting to court proceedings, as provided by the Law on Consumer Protection No. 6502.
